Terms and conditions (T & C) - Lagomera-Deluxe.com / Building "La Galeria"

Property owners: Andreas Koster-Clobes and Malte Koster, Calle La Alameda 68, 38870 Valle Gran Rey, SPAIN

1. Arrival and departure

The rented appartement will be available to you at 4 p.m. on the arrival day and has to be left on the departure day by 11 a.m.  Leaving more than 30 minutes late can result in us charging to you one additional day. However, if you arrive earlier or like to depart later, please let us know as soon as possible and we will give our best to acommodate your wishes.

We will ask for your estimated arrival time in the booking process. Should the renter not arrive by 10 p.m. on the arrival day, we consider the contract to be cancelled 48 hours thereafter. The appartement may then be rented to other customers.

A reduction of the agreed rent upon early departure will be paid as a goodwill, if we can rent the appartement to other guests. 

2. Special requests

We will try to fulfill your wishes, if possible. Special requests need to be confirmed in written by the owner. If you bring your pet, please inform us about the species and the size of your pet upon booking and present an insurance for your pet. Please ask your insurance company, if travel abroad with your pet is covered.

3. Payment

The rental contract becomes valid with the arrival of the downpayment on the owner's account. A downpayment of 25% is due no later than 7 days after the booking. The full payment is due no later than 30 days before your arrival.

If a payment deadline is not being fulfilled, the owner may cancel the contract. Non-payment will be interpreted as a cancellation, and the owner may rent the appartement to other guests.

All additional costs for water, waste and electricity are included in the price.

4. Cancellation

You may cancel the contract at any time. You need to inform us in written about your cancellation. With your cancellation, you owe the following compensation to the owner:

- Cancellation more than 91 days before your arrival: 10% of the rental price

- 90 days until 31 days before arrival: 25% of the rental price

- 30 days until the planned arrival date: 90% of the rental price

As a "fair owner", we will refund the cancellation charge in full (only withholding a 50 EUR transaction fee), if we are able to rent the appartement to somebody else. 

If you cannot come yourself, you may name another person to enter into your booking. 

5. Duties of the renter

The renter commits to be careful with the rented objects (Appartement, furniture and outdoor areas). Should any damage arise or things get broken during your stay, the renter is obliged to announce this to the owner immediately. Damages detected upon arrival have to be reported immediately to avoid being held responsible for these damages.

On the departure day, the renter has to remove all personal belongings, empty the garbage into the trash bin on the street, and leave the dishes and all devices used clean and in place.

6. Data protection

The renter agrees into the necessary recording and processing of his personal data in order to fulfill the booking. All personal data is being kept secured and being treated confidential.

7. Liability

The presentation of the appartements has been created to the best knowledge. The owner cannot be held liable for restrictions rhat occur due to force majeure, power- or water outages or severe weather. Furthermore, the owner may not be held liable for compensation if one of the following occurs: Orders of the local authorities including restrictions of use or closure of the property, construction or repair works or local events. The owner will help to solve all issues as far as this is within his possibilities.

The owner cannot be held liable for the loss or damage of personal belongings of the renter due to theft or fire. The renter will be held liable for all damages caused willfully to the property, furniture or devices in the appartement. 

8. Final provisions

Photos and texts on the website are made to describe the appartements realistically. We can not guarantee a 100% accordance, as furniture and devices may have to be exchanged.

If a provision of this agreement is or becomes legally invalid or if there is any gap that needs to be filled, the validity of the remainder of the agreement shall not be affected thereby. Invalid provisions shall be replaced by common consent with such provisions which come as close as possible to the intended result of the invalid provision. In the event of gaps such provision shall come into force by common consent which comes as close as possible to the intended result of the agreement, should the matter have been considered in advance. Any changes of or amendments to this Agreement must be in writing to become effective.
